Acceptance
By creating an account and clicking 'I agree' at registration, you enter into a binding agreement with Latimont on these Terms of Use. Our processing of your personal data is described in the Privacy Policy. If you do not agree, do not create an account or use the service.
Eligibility
Criteria is available to FCA-regulated mortgage advisors operating in the United Kingdom. By using the service, you confirm that you are authorised and regulated by the Financial Conduct Authority. Latimont reserves the right to verify your regulatory status at any time and to terminate access if you are not, or cease to be, appropriately authorised.
Account
One account per individual. You are responsible for maintaining the confidentiality of your login credentials. Do not share your account. You are responsible for all activity under your account.
Permitted Use
Criteria is an information retrieval tool for querying mortgage lending criteria. Use is permitted for professional purposes only. Do not input client personal data, borrower names, addresses, or other identifying information into queries.
Prohibited Input
Do not input client personal data into Criteria. This includes borrower names, addresses, contact details, national insurance numbers, or any other identifying information. Any personal data input in breach of this requirement remains your sole responsibility. Latimont may delete such data without notice and accepts no liability for its processing.
No Advice
Criteria is an information retrieval tool. It does not constitute regulated advice. Your regulatory obligations, professional duties, and duty of care to your clients remain entirely your own. Use of Criteria does not replace your own due diligence or compliance with FCA requirements.
Accuracy & Verification
Criteria uses large language models within a structured retrieval architecture designed to minimise error. Queries are processed by third-party infrastructure providers to generate responses based on published lender criteria. Independent verification remains essential. Lender criteria is updated regularly, though currency cannot be guaranteed. All outputs link directly to official lender documentation for verification.
Intellectual Property
Criteria, its underlying systems, architecture, and all associated intellectual property belong to Latimont. You are granted a limited, non-exclusive, non-transferable licence to use the service for its intended purpose. You may not copy, reverse engineer, scrape, or attempt to extract the underlying technology.
Availability
Criteria is provided on an as-is basis. Latimont may modify, update, suspend, or discontinue the service (or any part of it) at any time, without notice and without liability.
Termination
Latimont may suspend or terminate your access at any time, for any reason or no reason, without notice and without liability. Upon termination, your query history and account data will be handled in accordance with the Privacy Policy.
Disclaimer of Warranties
To the maximum extent permitted by law, Criteria is provided without warranty of any kind, express or implied, including but not limited to warranties of accuracy, completeness, reliability, fitness for a particular purpose, or non-infringement. Latimont does not warrant that outputs are current, correct, or complete.
Limitation of Liability
To the maximum extent permitted by law: Latimont shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, clients, data, or business opportunity, arising from your use of or reliance on Criteria. Latimont shall not be liable for any decision made or action taken based on information retrieved through Criteria. Latimont's total aggregate liability for any claim arising from or related to Criteria shall not exceed the total fees paid by you to Latimont in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Latimont, its officers, directors, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of Criteria; (b) your reliance on outputs; (c) your breach of these Terms; or (d) any advice you provide to your clients.
Dispute Resolution
Before initiating any formal proceedings, you agree to contact support@latimont.com and attempt to resolve the dispute informally for a period of 30 days.
Force Majeure
Latimont shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to third-party infrastructure failures, internet disruptions, cyberattacks, or acts of God.
Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to Terms
Latimont may update these Terms at any time. Continued use of Criteria constitutes acceptance of the current Terms.
